Welcome to Southeast Axle Repair (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our services, including but not limited to our marketing, CRM, SMS, and email automation services, including A2P (Application-to-Person) messaging in compliance with The Campaign Registry (TCR). By using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our services, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must discontinue use immediately.

2. Services Provided

Our services include but are not limited to:

  • Digital marketing, advertising, and CRM solutions
  • SMS and email marketing campaigns
  • Social media management and automation
  • Lead generation and customer engagement tools

3. Eligibility

To use our services, you must be at least 18 years old and have the legal authority to enter into a binding agreement.

4. A2P Messaging Compliance & TCR Requirements

We comply with The Campaign Registry (TCR) and all A2P messaging regulations, including but not limited to:

  • Registration: All A2P 10DLC campaigns must be registered with TCR. Clients are responsible for providing accurate business and campaign details for registration.
  • Consent & Opt-In: You must obtain explicit consent from recipients before sending marketing messages. Opt-in records must be maintained for compliance.
  • Opt-Out Mechanism: All SMS messages must include an opt-out option, such as “Reply STOP to unsubscribe.”
  • Message Content Guidelines: Messages must not include illegal, fraudulent, or misleading content, including spam, phishing, or prohibited content per TCR guidelines.
  • Delivery & Filtering Compliance: Carrier networks may filter non-compliant messages. We are not responsible for message delays or blocks due to carrier regulations.

5. User Responsibilities

  • You agree not to send unsolicited messages or spam.
  • You must comply with all applicable federal, state, and local laws, including but not limited to TCPA, CAN-SPAM, and GDPR (if applicable).
  • You are responsible for ensuring your campaigns adhere to industry best practices and compliance guidelines.

6. Account Registration & Security

  • You are responsible for maintaining the security of your account credentials.
  • Unauthorized access or use of another user’s account is strictly prohibited.

7. Payment & Fees

  • Services may be subject to one-time, subscription, or usage-based fees.
  • Non-payment or late payment may result in service suspension or termination.
  • SMS messaging fees are billed based on usage, with charges subject to carrier rate changes.

8. Prohibited Use

You may not use our services for:

  • Fraudulent, deceptive, or illegal purposes
  • Sending messages containing hate speech, violence, or adult content
  • Violating carrier policies or bypassing regulatory requirements

9. Data Privacy & Security

  • We implement industry-standard security measures to protect customer data.
  • Your data may be shared with third-party providers (e.g., TCR, carriers) for compliance purposes.
  • Our full Privacy Policy governs the collection, use, and storage of your data.

10. Service Modifications & Termination

  • We reserve the right to modify, suspend, or discontinue services at any time.
  • Accounts violating these Terms may be suspended or terminated without notice.

11. Limitation of Liability

We are not liable for:

  • Message delivery failures due to carrier restrictions
  • Service interruptions caused by third-party providers
  • Any indirect, incidental, or consequential damages arising from service use

12. Indemnification

You agree to indemnify and hold us harmless from any claims, liabilities, or damages arising from your violation of these Terms or misuse of our services.

13. Dispute Resolution

  • Any disputes will be resolved through binding arbitration in Florida.
  • Each party agrees to waive class-action rights.

14. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

15. Changes to These Terms

We reserve the right to update these Terms at any time. Continued use of our services constitutes acceptance of any revisions.
